DESCRIPTION OF DOG BEING SOLD
Buyer agrees to purchase from Seller a Puppy/ Dog (referred to hereafter as the "Dog") of the following description:

PURCHASE PRICE
Purchase price of the Dog for the Dog mentioned in this contract is _____________ Seller has already received a
deposit of_____________ The balance is due two weeks before the dog/puppy is to go home .
Puppy will have Limited Registration Full Registration (breeder Initials)______ . All shipping fees are the
responsibility of the buyer.
* If other arrangements please see additional agreement at the end of the contract.
If buyer has placed a deposit on a puppy it is non refundable and buyer fully understands this by signing below.

GENERAL TERMS
Seller certifies that the Dog is in good health, is appropriately vaccinated, and has been treated for parasites. Buyer
may return the Dog for a full refund or replacement at sellers discretion with in 72 hours of receipt. Seller must receive
a written letter from the vet within this time or we will not guarantee this puppy. If it is agreed upon and dog/puppy is to
be returned to our kennel it will be returned in the state and condition it left our kennel. Within this time period, Buyer
must have the Dog examined by a Veterinarian.
American Kennel Club registration papers shall be transferred to Buyer within 60 days from the time of purchase and
only if a contract was signed. Reason for the 60 day hold is so that we can make sure that you and the dog are
compatible.
Seller shall provide Buyer with any advice or assistance pertinent to the care, feeding, grooming, training, etc. of the
Dog upon request from Buyer.
Buyer agrees as follows:
Buyer shall provide complete Veterinary care for the Dog, including regular immunizations and health checkups by a
licensed Veterinarian, at the Buyer's expense.
Buyer agrees to maintain the Dog on a monthly or daily heart worm preventative throughout the Dog's life. (In applicable
areas)
Buyer shall insure that the Dog is fed a premium quality dog food. This Puppy/Dog has been on ProPlan puppy brand
Dog food. If this puppy isn’t fed a high quality kind of puppy/Dog food and does not grow into a sound healthy adult dog
due to lack of nutrition because you chose a different brand of dog food I will NOT REPLACE THE PUPPY/DOG..
Buyer shall keep the Dog as a house Dog with a properly fenced yard (4 feet or higher) or in a kennel run with proper
housing. Buyer agrees that at NO time will the Dog be chained or allowed to run free outside of a confined area.
Buyer shall attend at least one beginner's obedience class of at least six weeks duration. Proof of finishing the class
must be sent to breeder after completion. *If Buyer does not attend an obedience class breeder does not have to
guarantee this puppy .
Buyer will also socialize Dog among people and other animals for the life of the dog. This might involve taking the dog to
outings such as kids games, pet feed stores, walks, family gatherings etc. This will help keep the dog socialized with all
different people, kids and animals. This must be done for the life of the dog from puppy hood especially until you no
longer have the dog.
Buyer agrees this Dog will not be over excised or go up large flight of stairs before two (2) years of age. This is because
puppy’s bones are soft and this might cause problems with the hips and elbows.
Buyer agrees the Dog will not be bred unless other wise stated by the breeder. If this dog is ever bred whether it be
planned or accidental the contract is void and we will NOT guarantee this dog. Also it will be given back to
seller/breeder and its papers will be signed over to OP akitas. We will take legal action and all court cost and a fee of
$2,500.00 will be paid to breeder/seller.
Buyer shall keep Seller informed about the Dog's progress in activities and general health.
Buyer agrees to pay all of Seller's court costs, legal fees (including reasonable attorney's fees) incurred by Seller while
enforcing this
contract.
Buyer agrees that if they do not sign our contract we will not guarantee the puppy they get from us nor will they receive
the puppies papers.
Buyer agrees to use the name Orients Pride as the first part of the dog’s AKC registration name.
Socialization- Socializing will help to lay a solid foundation for the future of your Akita's temperament and acceptance
to new obstacles. Socializing at an early age is imperative and for the rest of your akitas life if you want him to be a well
socialized family pet.As far as the family children are concerned, there are a few worries. Akitas are devoted, patient
friends and protectors of children. Akitas are typically very gentle with children, and it is said that Japanese mothers
often left their children with only the Akitas to watch over and protect them. You must respect this and not only allow
your akita to be around your children but others as well so they respect all children as well as adults. The key to owning
an akita is what you put into your akita is what you will get out of your akita. No time spent with the akita as a pup and
for the life of the dog you are probably going to encounter a problem. They are like children you need to put a lot of
time into them if you want them to become the best they can be.
GUARANTEES
Seller guarantees the following:
Puppy will have a 1 year guarantee from purchase date. If it is determined that the puppy has a hereditary health
problem we will replace the puppy with another puppy when one becomes available and only when proof from a
certified vet and second opinion has been given to the breeder.
Seller/Breeder WILL NOT replace any Dog that is found to have hip problems due to environmental or nutrition. Seller/
Breeder has the right to have dog examined buy a vet of her choice to view the hips/elbows or eyes for a second
opinion. If seller/breeders wasn't given the right to a second opinion this contract is void and we will not guarantee this
dog. We only do replacements we do not give refunds.
The Dog will be free of genetic disease that would preclude its living an otherwise normal and healthy life.
* All medical expenses are the responsibility of the new owner. If the dog ends up having a problem and the new
owner/buyer elects to have the dog have medical treatment it is at the buyers expense. We offer only a replacement
should the dog come down with any hereditary problems as stated above for 1 yr. As with any living breathing
creature some things are beyond our control and are things that are unseen, (cancer, seizers, Allergies etc) We try to
breed the best we can but we are not god and sometimes things do come up.
*Temperaments- This puppy has been well socialized from day one till it leaves our home. It has an excellent
temperament. He/she has been socialized with children and people if for any reason his /her temperament is to change
we will not guarantee him if it is lack of socialization on your part. We have the right to have an expert in dog training,
Vet or another Akita breeder to evaluate the temperament of this dog if it should change. It will be at the expense of the
buyer not the seller. Should the dog be found to have a temperament problem due to medical reasons we will reimburse
the buyer for the evaluation and will make arrangements to what should happen to the dog. If it is deemed that it must
be put to sleep we will give a replacement. We take great pride in socializing our dogs/puppies very well and with
many generations of excellent temperaments in our lines we feel confident on this dogs temperament if it is kept well
socialized as we described above.. If Buyer should be unable to keep the Dog, Buyer MUST return the Dog at Buyers
expense and transfer its registration papers to Seller. If Seller so chooses to purchase the Dog back it will be for same
or less than the original purchase price, but not More buyer is not to place dog in another home without written
permission from Seller. If the Dog is placed in a mutually agreeable home, Buyer shall furnish Seller the name, address,
and telephone number of the new Owner. If however this dog has been bred with out health clearances done and the
owner no longer wants the dog the dog will either be placed in a home of the Sellers choice or the dog will be
given back to the breeder/seller at NO Charge and papers will be transferred over at that time.
VI. CONTRACT AMENDMENT
Any changes or additional terms to this Sales Contract must be made in the form of an Addendum and signed by all
Parties. Seller reserves the right to have a second veterinarian of their choice evaluate the Dog's condition before
honoring the guarantee. If seller does not get the choice or chance for the second opinion this contract for guarantee is
void and we will not replace the dog. If any part of this contract isn’t followed we do not have to guarantee this akita
puppy buyer is fully aware of this by signing this contract.
VII. SEVER ABILITY
If any provision of this Sales Contract is or becomes void or unenforceable by force of operation of law, the other
provision shall remain valid and enforceable.
VIII. LAW TO APPLY
Both Parties agree that the law of the State of New York shall apply to this Sales Contract and that this Sales Contract
shall be enforceable in Malone, New York.
IV. LIQUIDATED DAMAGES
The Parties agree that it is difficult to accurately calculate actual damages for breach of this contract. The Parties agree
that in the event that Buyer breaches any term of this contract, Buyer shall pay Seller One Thousand Dollars ($1000.)
in damages in addition to the return of the Dog plus any legal fees and costs associated in the enforcement of this
agreement. The parties agree that this amount of liquidated damages is reasonable and not punitive in any respect.
Client/Buyer must agree and understand that violation of this contract or if Buyer is to damage the goodwill
and reputation of Orients Pride Akitas and the breed in general Buyer will pay $5,000 and any other fees
associated with the dog or our kennel. All the terms and conditions of this contract should be adhered to. Seller
may/will impose a $2,500.00 non-compliance fine if this contract is breached. This contract is formed and shall be
governed by the laws of the State of New York, and jurisdiction to resolve disputes rests solely in a court of competent
jurisdiction in New York. Any legal action Client brings against Seller must take place in Seller's county of residence.
The undersigned have read and understood this Sales Contract and agree to the terms and conditions set forth herein.
